Kyle police are still investigating the traffic death of a two-year-old boy late last week and are hoping an unknown motorcyclist who may have witnessed the accident will come forward.
Estaban Olivares was pronounced dead at the scene last Friday following the 1:53 p.m. accident on the IH-35 Frontage Road near the Hays CISD offices.
According to Capt. Pedro Hernandez of the Kyle Police Department, there was some sort of “verbal altercation” between the cyclist and people inside four-door passenger car.
After that, he said, the car apparently started chasing the motorcycle when the driver appeared to lose control. Hernandez said the car went into the northbound lane of traffic and struck the rear axle of an 18-wheeler.
The driver, identified as 16-year-old Richard Nunez, and a passenger, Cynthia Garcia, were taken to Austin’s University Medical Center at Brackenridge by helicopter.
A third passenger identified as Michael Roark had head injuries and was taken to a hospital by ground ambulance.
In all, he said there were four adults and two children in the car.
The child who was killed had been in the left rear passenger seat and was not in a child safety seat.
No charges have been filed and the case remains under investigation.
Hernandez stressed that the motorcyclist is “just a witness” in the case. No physical description of him was available other than he was a white or Hispanic man. His motorcycle was described as a “chopper style” painted brown with orange flames.
Anyone with any information is asked to contact Kyle Detective Jake Luria; those wishing to remain anonymous can contact Crime Stoppers at 353-TIPS from the San Marcos calling area or at (800) 324-TIPS toll-free.
