Update: Suspect's name released; no charges against resident
San Marcos — San Marcos police do not anticipate filing criminal charges against a resident who shot three Luling teenagers, killing two, early Friday morning after they broke into his home in a west San Marcos neighborhood in an attempted home invasion.
Police Chief Howard Williams said Friday afternoon that police will turn the case over to the Hays County District Attorney's office for review
upon completion of the investigation. "At this time, we do not anticipate filing charges against the resident for firing the shots," Williams said.
Two teens died and a third was hospitalized after four youths allegedly invaded a home on Chestnut Street. A fourth teenager was not injured and
is currently jailed at the Hays County Law Enforcement Center.
Frank Castro, age 17,of Luling was charged with aggravated robbery, a first degree felony. Justice of the Peace Joanne Prado set bond at $50,000.
The shootings happened shortly before 2 a.m. on Chestnut Street on the west side of San Marcos. The resident, whom police have not identified,
fired several shots with a 40-caliber Glock handgun after the youths broke into the home. Three of the youths were carrying weapons that
police said included a handgun and two pellet guns that resembled real firearms.
One 16-year-old was pronounced dead at the scene and a second 16-year old died at Central Texas Medical Center. A third teen, also 16, was
transported to Brackenridge Hospital in Austin with serious wounds.
Police are withholding the identities of the juveniles as the investigation continues.
According to Chief Williams, police responded to a call of a home invasion with shots fired at 1:52 a.m. Friday. When police arrived, they
found several people shot by a resident of the home.
Three residents were in the home at the time of the incident and were not injured. Police did not release the names of the residents. One is a
Texas State University student and two are non-students.
