San Marcos — An Austin man's fifth conviction for drunken driving has drawn a sentence of 27 years from a Hays County jury.
Danny Lee Yeakley, 50, was pulled over on IH-35 by San Marcos police on June 6, 2008 for failure to signal lane changes. Patrolman Jason Scott testified that he stopped Yeakley intending to write a citation, but found him smelling of alcohol and appearing intoxicated.
"Yeakley refused to perform any field sobriety tests or submit to an intoxilyzer test," Assistant District Attorney Fred Weber said. An open beer can was found on his vehicle's floorboard, Weber said, adding that Yeakley told Scott he had consumed two beers between Austin and San Marcos.
Yeakley served 30 months for a felony 2003 DWI conviction in Travis County, Weber said. Similar convictions in Austin County in 1992 and Brazoria County, 1994, were misdemeanors.
