Another suit is filed by families of fire victims

The list of parties suing the owners and management of Iconic Village apartments keeps growing more than two months after the fire that killed five residents, injured numerous others and displaced about 200. 

The parents of Haley Frizzell, 19, and David Ortiz, 21, two of the apartment residents who died in the July 20 blaze, have joined a lawsuit filed by the family of Zachary Sutterfield. Sutterfield remains hospitalized in San Antonio with head trauma and burns over 70 percent of his body. The suit names management company Elevate Multifamily, manager Deborah Jones and apartment owners San Marcos Green Investors as defendants.

The Frizzells and Ortizes joined the lawsuit not long after the mother of another resident killed in the fire, Belinda Moats, 21, signed on as an intervenor in another lawsuit. Earlier this month, Moats’ mother, Marisela Rodriguez, joined the case filed by Phillip Miranda, whose son James, 23, was killed in the apartment fire. Miranda’s lawsuit, filed on July 30, was the first suit to come after the fire. Nine other plaintiffs have signed on to Miranda’s suit, which names a fourth defendant, manager Thomas Steubing, not named in the other lawsuits. Apartment residents Steven Mroski and Zachary Rosenfeld have filed a separate lawsuit against the managers and owners. All of the cases have been filed in district court in Travis County. The defendants’ attorney, Jennifer Akre, has not responded to inquiries about the lawsuits.
