Suspect in shooting near SMHS arrested San Marcos Police arrested Davis Samuel Briley, 29, of San Marcos, on Thursday in connection with shots fired at an apartment complex across the street from San Marcos High School before classes began. No injuries were reported and SMHS class schedules were unaffected.
SMPD officers responded to a report of multiple gunshots in the 1000 block of Vervain Road at approximately 5:20 a.m. on Aug. 21.

SMPD officers were able to take Briley into custody “within minutes,” according to a SMPD spokesperson.
Preliminary information alleges the shooter was staying at the complex but was not connected to either of the two apartment units that were were hit by gunfire.
Briley has been charged with tampering with physical evidence, a thirddegree felony. The investigation is ongoing to determine what caused the him to fire multiple shots. Additional charges are possible.
Briley was previously arrested for cruelty to animals and assault family violence in 2024 and later found guilty of these charges.
