HAYS COUNTY COMMISSIONERS COURT
The Hays County Commissioners Court approved a burn ban until Jan. 20, 2026, when the court will meet again and review conditions regarding a further extension. However, use of fireworks will not be restricted in the unincorporated areas of Hays County during this ban, which includes the New Year’s holiday.
“After consultation with Hays County Emergency Management personnel, outdoor burning is prohibited during this period,” Hays County Judge Ruben Becerra said in a press release.
Mike Jones, Director of the Hays County Office of Emergency Services, initially suggested a three-month extension of the burn ban during the Commissioners Court meeting on Tuesday.
“It’s pretty dry out there as it stands right now. I’m recommending along with the fire marshal that we continue the burn ban for another 90 days,” Jones said.
Commissioner Walt Smith suggested a shorter 30-day burn ban, followed by a review of conditions before a further extension.
Judge Becerra proposed extending the ban until the Jan. 20 court meeting, a motion which was approved unanimously by the Commissioners.
Following approval of the burn ban, Judge Becerra discussed the creation of an agenda item regarding the use of fireworks.
“No fins, no sticks, is how we usually handle fireworks during a burn ban,” said Becerra.
“And aerials,” added Jones.
Commissioner Walt Smith said the court had previously considered agenda items regarding the use of fireworks for New Year’s celebrations earlier in the year. “That’s what my concern is, that we usually do an order in late November, early December for New Year’s and we didn’t do it this year,” he said.
The court was informed by Assistant General Counsel Jordan Powell that it was too late to limit fireworks use for this holiday season.
“The deadline for the Court to order a restriction on the sale and use of those fireworks is already past. … you cannot regulate it,” said Powell.
These rules do not impact areas within city limits, as each city in Hays County has it’s own set of rules and regulations on fireworks.
In his press statement, Becerra said that there are currently no restrictions on fireworks. “However, we strongly urge residents to use caution and remain mindful of the elevated fire risk.
“I encourage all community members to stay alert, follow fire-safety guidelines, and report any signs of smoke or fire immediately,” Becerra said.
